Canadians Can Now Cancel their Contracts without Penalty after Two Years: CRTC Wireless Code Comes into Force

The wireless code of the Canadian Radio-television and Telecommunications Commission (CRTC) allows Canadians to terminate their contracts without paying any cost, once they complete a maximum of two years. Moreover, it also facilitates the understanding of contracts for cell phones and other mobile devices. This way it sets out basic rights for Canadians.

Due to this wireless code coming into effect, it is now possible for Canadians to make informed decisions about their choice of wireless services and service providers. After all, it is important to find the best deal that meets your needs at least for two consecutive years, if not more often. Adopting innovative practices is the best way wireless companies can satisfy their existing customers and attract new ones.

The CRTC wireless code will apply to

  • New Year contracts that are signed as of December 2, 2013
  • All existing contracts ready to be extended or renewed
  • Contracts that include amended key terms as of December 2, 2013
  • All wireless contracts as of June 3, 2015 regardless of signing date

What does the wireless code mean for individual customers or small business consumers?

  • New Year contracts that are signed as of December 2, 2013
  • They may cancel their wireless contracts after completing two years without paying any cancellation fees
  • They can set limits on excessive data charges (at $50/month) and national and international roaming charges (at 100$/month), based on their plans
  • They can have their cell phones unlocked immediately if they pay in full for the device, otherwise after 90 days
  • If unhappy with the service, they can return their cell phones within 15 days
  • Receive a simple and easy-to-understand contract
  • They can accept or reject the changes made to the key terms mentioned in a fixed-term contract (i.e., two years)

During its public consultation, the CRTC came across several concerns of Canadians regarding their wireless contracts, including the length of contracts, bill shock, and cancellation charges. The CRTC developed the wireless code, at the request of the wireless industry. The code addresses all the problems that Canadians shared with them.
